Claiming something as a company and not a person is a dangerous thing. You can do so much damage to yourself by claiming a company as a company and not what it is.
For example, we recently took a look at the “Fraudulent Company” claim in the New York state case against Microsoft. The company that used to be Microsoft Corporation was using the name “Microsoft Corporation” and its former CEO, Steve Ballmer, was the sole owner. One of the employees we looked at was claiming to be a Microsoft employee, but the company that he was claiming to work for was actually run by his father.
This is a situation where you have to be careful because the name is really the company. If you claim a company’s name, you may have a hard time proving that you are actually the company. For example, a company that hires consultants will have a hard time proving that it’s the company it says it is. When you are trying to sell a company, you may try to make up a name that’s not really the real deal.
If you’re trying to set up a company, you can try to get a company that appears to be the real deal and get them to hire you. However, if you are trying to buy a company, you have to make sure you have a legitimate reason for buying and hiring people in the first place. Otherwise your entire company is a fraud.
To be honest, when I first read a company’s name I was expecting the real deal. After all, I thought the guy must be a high-powered lawyer or something. Turns out that claim associate is just a front.
Claim associates are basically the ones that run through your company checking out if there are any liability issues. They’ll show you their background check, review your books, and see if you have any history of fraud, misappropriation, or any other questionable practices. They will then refer you to a lawyer to set up a company charter or form the legal structure for you.
Claim associates are an incredibly underpaid position that you pay to play. The best part about the job is seeing how many claims associate jobs you have and how well the lawyers you hire know it.
Sure, you can make a lot of money on the claim associate side of things, but you should also make sure that you do what you can to ensure you’re not getting ripped off. Always check out the company websites for their background check and make sure you understand all of the issues you’re signing up for.
I can say with absolute certainty that I have had a few associates claim jobs in my career. In fact, I know several people that have had claims associates on their resumes since the days of the early 90’s.
